Terms of Use

These terms govern your use of Calibrate's website, questionnaire, consult flow, saved protocol flow, account experience, generated output, and related services. By using Calibrate, you agree to these terms.

Eligibility and acceptance

You may use Calibrate only if you can form a binding agreement and use the service lawfully.

  • You must be at least 18 years old.
  • You must provide accurate account information and keep your email or authentication credentials secure.
  • If you use Calibrate for an organization, you represent that you are authorized to bind that organization to these terms.

Educational wellness service only

Calibrate is an educational wellness product. It is not a medical device, not a clinical service, and not a substitute for care from a qualified clinician. It does not diagnose, treat, cure, or prevent disease.

  • Calibrate does not replace a physician, therapist, sleep specialist, or other qualified clinician.
  • Do not use Calibrate for emergency decisions, diagnosis, prescription decisions, or treatment planning.
  • If you have persistent symptoms, severe sleepiness, breathing issues during sleep, mood or safety concerns, safety-sensitive shift-work concerns, or another urgent condition, seek qualified care.
  • Using Calibrate does not create a physician-patient relationship, therapist-client relationship, or other licensed professional relationship unless a separate formal care process is created and completed.

Emergency and urgent-care notice

Do not use Calibrate for emergencies or urgent medical needs. If you may be experiencing a medical emergency, call emergency services. If you need medical advice, diagnosis, or treatment, contact a qualified clinician.

Sensitive information

Questionnaire, consult, and protocol data can be sensitive. You should not submit information that Calibrate does not ask for, and you should avoid using the product to communicate emergency symptoms, diagnosis requests, medication changes, lab results, insurance information, or treatment instructions.

Your responsibilities

You are responsible for how you use the product and for the accuracy of the information you submit.

  • Questionnaire answers should be truthful and current to the best of your knowledge.
  • You are responsible for reviewing generated guidance in the context of your real schedule, environment, health history, and professional advice.
  • You must not share access links, attempt to bypass security, or use Calibrate to harm, harass, defraud, or mislead others.

Accounts, drafts, and generated protocols

Calibrate may let you create an account, save draft responses, and unlock generated protocols, guidance, or calendar outputs.

  • Saved outputs depend on the information you provide and may change if you update your inputs, the product, or the underlying protocol logic.
  • You are responsible for keeping your email account, authentication links, and account access secure.
  • We may change, suspend, or discontinue features, protocol formats, or workflows as the product evolves.
  • We may suspend or terminate access if we reasonably believe you violated these terms, created security risk, or used the service unlawfully.

Third-party services

Calibrate relies on third-party providers for infrastructure, authentication, database hosting, communications, background jobs, analytics, monitoring, security, storage, backup, and anti-abuse controls.

  • Your use of those connected services may also be subject to the provider's own terms and privacy policies.
  • Calibrate is not responsible for outages, delays, or acts caused solely by third-party platforms outside our reasonable control.
  • Calibrate may use server-generated affiliate click IDs for attribution. Affiliate redirects must not include questionnaire answers, protocol content, health labels, email addresses, or raw IP addresses.

Intellectual property and license

Calibrate and its content, branding, workflows, and software are owned by Calibrate or its licensors.

  • We grant you a limited, revocable, non-exclusive, non-transferable license to use Calibrate for your own lawful internal use.
  • You may not copy, resell, reverse engineer, scrape at scale, build a competing dataset, or exploit the service beyond that limited license unless Calibrate gives written permission.
  • You retain rights in the information you submit, but you grant Calibrate permission to host, process, reproduce, and transform that information as needed to operate, secure, and improve the service.

Disclaimers

Calibrate is provided on an as-is and as-available basis to the fullest extent permitted by law.

  • We do not guarantee that the service will always be uninterrupted, error-free, or suitable for every schedule, environment, or health context.
  • We do not guarantee any specific sleep, focus, energy, productivity, or health outcome.
  • Generated guidance may be incomplete, outdated, or unsuitable for your circumstances. Use judgment and seek professional advice when appropriate.
  • Any product or environment recommendations are optional supports, not mandatory treatment instructions.

Limitation of liability

To the fullest extent permitted by law, Calibrate and its affiliates, founders, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service.

  • That limitation includes loss of profits, revenue, data, goodwill, business interruption, or substituted-service costs.
  • If applicable law does not allow some limitations, those limitations apply only to the maximum extent allowed.
